RFK Jr. removed from NC ballot, Court of Appeals rules; no ballots can go out Friday

RALEIGH, N.C. (WNCN) — An order to stop ballots from going out Friday and to remove Robert F. Kennedy Jr.’s name from the ballot has been entered by the North Carolina Court of Appeals.

CBS 17 obtained the order which states the NC Board of Elections is “enjoined from disseminating ballots” which list RFK Jr. as a candidate for President of the United States.

This order comes just one day after a Wake County judge rejected RFK Jr.’s request to be removed from the ballot in North Carolina. It is unknown whether the State Board of Elections will attempt to appeal the order in the NC Supreme Court.

An email from the NCSBE to all county boards of election give guidance on what should and should not be done at a local level for now. The full email from Paul Cox, the General Counsel for the NCSBE says:

“Directors (via BCC):

The Court of Appeals just issued an order reversing the denial of the restraining order that was requested by Kennedy. It is attached. The court has ordered a further pause to ballot distribution. Do not send any ballots out today.

The court has also ordered that the We The People party’s ballot line be removed (including Kennedy and Shanahan). Obviously, this will be a major undertaking for everyone. Our attorneys are reviewing the order and determining how to move forward. No decision has been made on whether this ruling will be appealed.

Bottom line: continue to hold your outgoing absentee ballots—both military and overseas citizen ballots, and ballots for civilian voters. We will update you immediately with any further developments.”
