One of Nix's suspects will now face capital murder charge

GREENSBORO, N.C. — One of the suspects charged with killing Greensboro police Sgt. Dale Nix is now facing a capital murder charge. 

Officer Nix was shot and killed last December after investigators say he was trying to stop three people from stealing beer from Sheetz in Colfax. 

In court Monday, 28-year-old James Morrison learned that he is now charged with capital murder and could face the death penalty. 18-year-old Jamere Foster was also in court. He will not face a capital murder charge. 

The District Attorney says the Nix family asked that Foster’s charge not be upgraded.
