MYRTLE BEACH, S.C. (WBTW) — A man is suing Dave & Buster’s and its Broadway at the Beach manager for more than $100,000 after he claims to have lost a finger while dining at the restaurant because of a chair, according to a lawsuit.
Usias J. Salaz filed the lawsuit in Horry County Common Pleas Court on Tuesday. It names Dave & Buster’s of South Carolina, LLC and its Myrtle Beach manager.
Salaz was at the 1322 Celebrity Circle Dave & Buster’s location on or about April 5, 2024, with his friends and family, the lawsuit said. Salaz shifted his chair/stool not realizing the screws to the stool’s cushion were loose.
Salaz’s right ring finger became trapped in between the cushion and stool, dismembering it, according to the lawsuit. It claims the cushion was in “violation of industry standards” by not being properly secured when Salaz sat down on it.
“This incident was not caused, in whole or in part, by any negligent act or omission by plaintiff,” the lawsuit reads before claiming that Dave & Buster’s should have known that chairs and stools can cause injuries if cushions aren’t properly secured.
The lawsuit further claims that Salaz dealt with pain and suffering, injuries to his hand and limitation of motion, mental anguish and anxiety, inability to perform normal duties at work and loss of enjoyment of life, among other things.
The lawsuit seeks more than $100,000 and punitive damages as well as a jury trial.
A request for comment from Dave and Buster’s on Wednesday was not immediately returned. Count on News13 for updates.
